Nos últimos anos, o Brasil tem passado por uma fase de desburocratização muito importante para o mercado nacional. A última notícia relacionada a esse movimento é o fim, em parte, da obrigação do SAT em São Paulo.
Até este marco, todo comerciante que desejasse emitir o documento fiscal para seus clientes era obrigado por lei a vincular o equipamento SAT, seja próprio ou alugado, com seu estabelecimento.

Para que serve o SAT?
O SAT é um aparelho que, em linhas gerais, serve como um backup de segurança na hora de emitir notas. Caso a loja fique sem internet ou o sistema de emissão de NFC-e (que veremos mais adiante) falhe, o SAT existe para comunicar à SEFAZ sobre as vendas que ocorreram no estabelecimento nesse momento que o comércio estava offline.
Além disso, esse equipamento era obrigatório para o credenciamento da empresa junto aos órgãos reguladores, para permitir que a loja emitisse notas ou cupons fiscais.
Com a desobrigatoriedade, o procedimento para liberar a emissão de notas será muito mais rápido, econômico e menos burocrático para o empreendedor.
O que mudou na legislação?
A última atualização relacionada ao tema do SAT havia ocorrido em 2015, mas uma nova portaria já está no ar.
Antes dessa mudança, todo lojista era obrigado a ter o SAT para solicitar a autorização da emissão de NFC-e. Agora, essa obrigação foi revogada. Ou seja, os comerciantes de São Paulo não precisam mais ter o equipamento SAT para conseguir realizar o credenciamento para emissão de NFC-e.
Note que a obrigação de posse para o credenciamento foi revogada, mas o resto da legislação de 2015 continua valendo, principalmente no que diz respeito à contingência. Os lojistas de São Paulo ainda não podem emitir NFC-e offline, como acontece nos outros estados brasileiros.
E quem já comprou o equipamento?
Para quem já comprou o SAT, basta continuar usando o equipamento normalmente, afinal, ele continua com sua finalidade intacta, sendo recomendado tê-lo no estabelecimento.
Basicamente, ele serve como medida de contingência, ou seja, quando o método usual de emissão de notas fiscais apresenta algum problema técnico e fica impossibilitado de operar.
Ou seja, apesar de não ser mais obrigatório já ter o SAT no momento do credenciamento, o equipamento ainda é necessário, caso surja a necessidade de emitir o documento fiscal em contingência.
O que é NFC-e?
Há algum tempo, o comprovante conhecido como Cupom Fiscal era vastamente utilizado pelos comerciantes brasileiros. Com os avanços tecnológicos e a modernização do sistema fiscal, surgiu a necessidade de criar um novo documento, mais parecido com a Nota Fiscal.
Hoje, então, usamos a Nota Fiscal de Consumidor Eletrônica, a NFC-e, que substitui o Cupom Fiscal.
A NFC-e é obrigatória em praticamente todos os estados brasileiros, tendo como principal vantagem a consulta on-line, por parte do consumidor. Para os lojistas, a NFC-e simplifica o processo de venda e de registro fiscal, antes feito manualmente.
O que fazer quando não der para emitir NFC-e?
A NFC-e é obrigatória no estado de São Paulo, portanto, empresas que não a emitem podem ser multadas pelo fisco.
Porém, se houver problema na hora da emissão, como falta de internet ou falta de comunicação com o fisco, o SAT deve ser utilizado como medida de contingência.Ficaram claras as alterações na legislação paulista?
